1. Acceptance

By downloading, installing, or using Stubbd (“the app”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the app and uninstall it from your device.

2. Eligibility

You must be at least 17 years old to use Stubbd, consistent with the App Store age rating. By using the app, you represent that you are at least 17, that you have the legal capacity to enter into these terms in your jurisdiction, and that you are not barred from using the app under any applicable law.

3. The app

Stubbd is an iOS application that helps adults quit smoking through five core tools: a brain-healing timeline visualizing dopamine-receptor recovery, a craving timer designed around the 3–5-minute craving half-life, an AI-powered coaching feature, a savings counter, and a relapse-as-data reframe. The app is sold and distributed through the Apple App Store.

4. Subscriptions, billing, and auto-renewal

Stubbd is a paid app with no free tier. Subscriptions are sold and managed entirely by Apple through the App Store under Apple’s terms.

Prices may vary by region and currency, and are displayed at the time of purchase in the App Store. The price you see in the App Store at checkout is authoritative.

4.2 Auto-renewal disclosure (Apple App Store)

The following terms are required by Apple App Store Review Guideline §3.1.2 and apply to all auto-renewing subscriptions:

  • Payment will be charged to your Apple Account at confirmation of purchase.
  • Auto-renewal. Your subscription automatically renews at the end of each subscription period at the then-current price unless you cancel at least 24 hours before the end of the current period.
  • Renewal charge. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.
  • Managing your subscription. You can manage your subscriptions and turn off auto-renewal by going to your Apple Account settings after purchase. Cancellation takes effect at the end of the current billing period.
  • Free trials. Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription, where applicable.

4.3 Refunds

All payments are processed by Apple. Refund requests are subject to Apple’s policies and must be made through Apple. We do not directly process refunds. To request a refund, visit reportaproblem.apple.com, sign in with your Apple ID, locate the Stubbd purchase, and follow the on-screen instructions.

4.4 Price changes

We reserve the right to change subscription prices for future renewal periods. Where required by Apple’s terms or by law, we will give you advance notice of any price increase and an opportunity to cancel before the change takes effect.

5. The AI coach

Stubbd includes an AI-powered coaching feature. The coach is not a medical professional, therapist, or counselor. Its responses are generated by a third-party large language model and may be inaccurate, incomplete, or inappropriate for your specific situation.

You acknowledge and agree that:

  • The AI coach will never diagnose a medical condition
  • The AI coach will never recommend a specific medication or dose; medication questions are routed to a “ask a healthcare provider” response
  • The AI coach will direct you to a crisis line if it detects crisis-related language, and may bypass its normal flow to do so
  • You will not rely on the AI coach for medical, psychological, or emergency advice

We make no warranty as to the accuracy, completeness, or fitness for purpose of any AI coach output.

6. No guarantee of outcomes

Quitting smoking is hard, individual, and non-linear. Stubbd does not guarantee that you will quit, stay quit, or achieve any specific health outcome. The brain-healing timeline shown in the app reflects general scientific consensus on dopamine-receptor recovery and is not a personalized clinical prediction for you.

7. Acceptable use

You agree not to:

  • Use Stubbd for any unlawful purpose
  • Reverse-engineer, decompile, disassemble, or attempt to extract source code from the app, except to the extent this restriction is prohibited by law
  • Use automated tools (scrapers, bots, headless clients) to access the app or its backend
  • Attempt to access another user’s account, data, or AI coach conversation
  • Misrepresent your identity, age, or health information in a way that could endanger yourself or others
  • Use the AI coach to generate harmful, illegal, harassing, sexually explicit, or hateful content, or content targeting minors
  • Resell, sublicense, or commercialize access to the app

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, and to refer suspected illegal activity to the appropriate authorities.

8. Intellectual property

The Stubbd app, the Stubbd brand and logo, the brain-healing timeline as visualized, the design system, and the underlying software are owned by us (or our licensors) and protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes, subject to these terms. All rights not expressly granted are reserved.

You retain ownership of the content you create within the app (your journal entries, your AI coach inputs). You grant us a worldwide, non-exclusive, royalty-free license to host, store, and process that content solely to operate the app for you.

9. Privacy

Your use of Stubbd is also governed by our Privacy Policy, which describes what data we collect, how we use it, and how to exercise your rights (including export and deletion).

10. Third-party services

The app integrates with third-party services to function: Apple App Store (billing), RevenueCat (subscription state), Supabase (database and authentication), OpenAI (AI coach inference), PostHog (analytics), Sentry (crash diagnostics). Your use of the app is also subject to the terms of those services where they apply directly to you (notably Apple’s). We are not responsible for outages, errors, or policy changes by third-party services.

11. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Stubbd, its operators, and its affiliates from any claim, demand, or damages (including reasonable attorneys’ fees) arising out of (a) your misuse of the app, (b) your violation of these terms, or (c) your violation of any third party’s rights.

14. Termination

You may stop using the app at any time and delete your account from Settings → Account. We may suspend or terminate your access for violation of these terms, for unlawful activity, or where required by law. Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, indemnification, governing law) will survive.

15. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, civil unrest, internet outages, third-party service failures (including Apple App Store, Supabase, or OpenAI outages), or governmental action.

16. Governing law and disputes

These terms are governed by the laws of [JURISDICTION TBD], without regard to conflict-of-laws principles. Any dispute arising out of or related to these terms or the app shall be resolved through good-faith negotiation; if not resolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts of [VENUE TBD].

If you are a consumer in the EU, this clause does not deprive you of mandatory protections under the law of your country of residence.

17. Changes to these terms

We may update these terms as the app evolves. Material changes will be announced via in-app notification at least 14 days before they take effect, and the “Last updated” stamp at the top of this page will be revised. Continued use of the app after a change takes effect constitutes acceptance of the updated terms. If you do not agree to a change, you may delete your account before it takes effect.

18. Miscellaneous

These terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the app, and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
